We access and manage advertising accounts through the Google Ads API, Meta Marketing API, and other third-party platforms in accordance with their respective terms of service and developer policies.

3. Eligibility

Our services are intended for businesses and individuals who are at least 18 years of age and have the legal authority to enter into binding agreements. By using our services, you represent and warrant that you meet these requirements.

4. User Responsibilities

When using our website or services, you agree to:

  • Provide accurate, current, and complete information
  • Maintain the confidentiality of any account credentials
  • Comply with all applicable laws and regulations, including advertising and data protection laws
  • Not use our services for any unlawful, fraudulent, or harmful purpose

5. Advertising Platform Compliance

Our advertising management services are subject to the terms, policies, and guidelines of third-party platforms including Google Ads and Meta. Clients acknowledge that:

  • Campaign performance is subject to platform algorithms, auction dynamics, and external market factors beyond our control.
  • We do not guarantee specific advertising results, conversion rates, or return on ad spend.
  • Advertising accounts may be subject to review, suspension, or restriction by the respective platforms at their discretion.
  • Our use of the Google Ads API complies with the Google Ads API Terms of Service and all applicable Google developer policies.

6. Intellectual Property

All content on this website, including text, graphics, logos, design elements, and software, is the property of INDEXED or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content on this website without our prior written consent.

Campaign strategies, reports, and deliverables produced as part of our services remain the intellectual property of INDEXED unless otherwise agreed in a separate written agreement with the client.

7. Confidentiality

Both parties agree to maintain the confidentiality of any proprietary or sensitive information shared during the course of our engagement. This includes, but is not limited to, business strategies, campaign data, financial information, and client lists.

8. Payment Terms

Specific payment terms, fees, and billing arrangements are set out in individual client agreements. Unless otherwise agreed in writing:

  • Fees are quoted in Australian Dollars (AUD) and are exclusive of GST.
  • Payment is due within the timeframe specified in the relevant agreement or invoice.
  • Late payments may incur additional charges as specified in the client agreement.

9. Limitation of Liability

To the maximum extent permitted by law, INDEXED shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to:

  • Your use of or inability to use our website or services
  • Any errors or omissions in advertising campaign performance
  • Actions taken by third-party platforms, including account suspensions or policy changes
  • Unauthorised access to or alteration of your data or transmissions
  • Any loss of revenue, profits, business, data, or goodwill

Our total aggregate liability for any claims arising from or related to our services shall not exceed the total fees paid by you to INDEXED in the twelve (12) months preceding the claim.

10. Disclaimers

Our website and services are provided on an "as is" and "as available" basis. We make no warranties or representations, express or implied, regarding the accuracy, reliability, or completeness of our website content or service outcomes. We disclaim all warranties to the fullest extent permitted by law, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

You agree to indemnify and hold harmless INDEXED, its directors, employees, and agents from any claims, losses, damages, liabilities, and expenses (including reasonable legal fees) arising from your use of our services, violation of these Terms, or infringement of any third-party rights.

Termination of specific service engagements is governed by the applicable client agreement.

These Terms are governed by and construed in accordance with the laws of New South Wales, Australia. Any disputes arising from or relating to these Terms shall be subject to the exclusive jurisdiction of the courts of New South Wales.

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated "Last updated" date. Continued use of our website or services after changes are posted constitutes acceptance of the revised Terms.

15. Severability
